Terms of Service
Last updated: November 7, 2026
Please note: Section 17 contains a binding individual arbitration agreement and a class action waiver. A disagreement we can't settle by email goes to a neutral arbitrator, one customer at a time, not to a judge, a jury or a class action. Small claims court stays open to you, and you can opt out within 30 days of your first order.
1. About these Terms
These Terms of Service ("Terms") are an agreement between you and Wonderito ("we", "us" or "our"). They cover wonderito.com, song.wonderito.com, the Wonderito Song order form and checkout, your account, song pages and our emails (together, the "Service").
By using the Service or placing an order, you agree to these Terms. Our Refund Policy and Privacy Policy are part of them.
2. Who can use Wonderito
To use the Service or buy a song, you must:
be at least 18, or the age of majority where you live if that is older;
be the child's parent or legal guardian, or have their permission to make a song about the child; and
be buying for personal or household use, such as for your family or as a gift, not to resell.
We don't knowingly collect personal information directly from children under 13. If you think a child has given us information, email us and we'll delete it. You can't use the Service where the law doesn't allow it.
3. How Wonderito Song works
Each song is about 2 to 2½ minutes long.
Extras: Express delivery (about 1 hour instead of about 12); a printable lyrics card (a gift-style PDF); a karaoke pack (a music-only MP3).
Checkout shows exactly what your order includes, and you get what was shown when you paid. Wonderito Song is a one-time purchase: there are no subscriptions, and nothing renews.
4. What to expect from your song
Every song is created by Wonderito through our own song-making process: our team and technology, working with production and technology partners. Please expect that:
a name may be sung a little differently from the way your family says it (you can ask for a free change, though we can't promise an exact sound);
creative results vary: the melody, voice or mood may not be what you pictured, and we may word your details our own way or leave some out;
we can't promise how anyone will react;
each song is made for its own order, but its melody or phrases may sound like other songs, including other Wonderito songs; and
we may replace a brand or famous name with a general phrase.
If we can't make a song, we'll tell you, cancel the order and refund it (see Section 11).
5. Your information and your content
You promise that what you tell us is accurate, including your email address (we deliver to the email you enter at checkout), and that you have the right to share the child's details and those of anyone else you mention.
Keep sensitive details out. Please don't enter health information, last names, addresses, school names, phone or ID numbers, passwords, financial details or anything you wouldn't want sung out loud. Anything you write may end up in the lyrics.
Content rules. Don't enter anything unlawful, dangerous, hateful, bullying, sexual, violent or defamatory; anything that breaks someone else's rights, such as copied lyrics or a request to imitate a real singer or band; someone's private information without their permission; or anything meant to mock or hurt a child or anyone else.
Our right to say no. We may refuse an order, edit or decline a lyric, or stop making a song if we reasonably believe it breaks these rules, could harm someone, or could break the law or our partners' rules. If we decline or cancel an order you've paid for, we refund it.
6. Characters, brands and famous names
A song can mention characters, shows, games, brands or people that you type in. Wonderito isn't affiliated with, sponsored by or endorsed by any of them, and a mention doesn't mean they approve of the song. All trademarks and characters belong to their owners. These mentions are only for your personal, non-commercial enjoyment.
7. How you can use your songs
When you buy a song, we give you a personal, non-commercial, non-exclusive, worldwide license that doesn't expire, unless it ends as described below, to use it and what comes with it: the lyrics and any lyrics card or karaoke pack. You can keep, play and download it, give it as a gift, share it with family and friends, play it at home or at family events, and post it on your personal social media, as long as the post isn't monetized, sponsored or promoting a business.
Unless we agree in writing, you may not:
sell the song or make money from it in any other way;
use it for a business or commercial purpose, including ads and sponsored content;
upload it to music streaming or distribution services, such as Spotify or Apple Music;
register it with Content ID or any other content-matching system, or with a collecting society; or
use any part of it to train, test or improve machine-learning or AI models.
Someone who gets a song as a gift may enjoy it under the same rules, but the person who paid stays our customer. The license ends for anything we refund, or if you use it in a way this section doesn't allow. After a refund, we may remove the item from your account, and please delete any copies you downloaded.
We or our licensors keep all the rights we have in the songs, artwork, extras, the site and our brand. Nothing in these Terms transfers ownership to you. You keep whatever rights you have in the words you type.
8. How we use what you tell us
You allow us to use your answers and revision requests to create, deliver and support your order and to run the Service, including sharing them with the partners that help us create and deliver songs.
We never sell your child's details or use them for advertising, and we won't use your child's song, name or story in our marketing without your permission. Our Privacy Policy explains what we collect, how we and our partners use cookies and similar technologies for analytics and advertising, and how to ask us to delete your information.
9. Your account
Your songs live in your private account at song.wonderito.com/en/account, tied to the email you used at checkout. There's no password: we sign you in with a link sent to your email, and you can get a new link any time at song.wonderito.com/en/account. Keep your email account secure, and don't forward delivery or sign-in emails, because their links open your songs. If you think someone else has gotten in, email us.
We keep your account available, but please download anything you want to keep. If we ever close it, we'll email you at least 30 days before.
10. Prices and payment
Any sales tax, VAT or GST is included in the price or shown before you pay. If a price is clearly wrong because of an error, we may cancel the order and refund you in full.
Checkout is run by our third-party payment processor, and its terms also apply to your payment. Your card details go straight to the payment processor; we never see or store your card number. We may hold an order to check a payment, then either make your songs or refund you in full.
Extras bought later are separate payments.
11. Delivery and refunds
Delivery. Standard orders are usually ready within 12 hours of payment and Express orders within 1 hour. These times are estimates. All the songs in an order arrive together: we email you a link to your song page. If your song doesn't arrive, check your spam or promotions folder and your account, then email us within 7 days of your purchase.
Refunds. Our Refund Policy has the details, and it applies if it ever disagrees with these Terms. In short:
All sales are final. Every song is a personalized digital product made to order, so there are no refunds for a change of mind, taste, style, voice, mood or a mistyped email. Orders can't be cancelled once paid, because we start making your song right away.
Right of withdrawal. At checkout, you agree that production starts immediately, and you waive your right of withdrawal for this personalized digital product.
When we refund. Only if we can't deliver your order within a reasonable time after you've taken the steps above, if you were charged twice, if a file has a technical defect (it won't play, cuts off or is silent) that we can't fix with a new file, or if we decline or cancel your order. Apart from these cases, Express and extras are non-refundable once paid, including when your songs arrive later than the estimate.
How refunds are paid. Refunds go to your original payment method. Banks usually take 5–10 business days to show them.
Chargebacks. Please contact us before disputing a charge with your bank. For an order we delivered, we'll send our payment processor proof of delivery, and we may suspend access to that order while the dispute is open.
12. Using the Service fairly
Please don't use bots or scrapers on the Service; abuse our limits; reverse engineer the Service, except where the law allows; interfere with its security or payment checks; try to open accounts that aren't yours or guess song page links; pretend to be someone else; or use the Service to build a competing product or to collect data to train machine-learning or AI models.
13. Suspending or ending access
You can stop using the Service at any time. We may limit, suspend or end your access, or cancel an order, if we reasonably believe you've broken these Terms or are committing fraud or abuse, or if the law requires it. We may also change, pause or stop parts of the Service. If we cancel an order or stop before delivering an order you've paid for, we refund it.
Sections 7 and 14 to 18 still apply after your access ends.
14. Disclaimers
To the fullest extent the law allows, the Service and the songs are provided "as is" and "as available". Beyond what these Terms, the Refund Policy and checkout tell you, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise the Service will always be available or error-free.
Nothing in these Terms limits rights you have under applicable consumer law that can't be waived.
15. Limits on our liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, lost profits or lost data. Our total liability for any claim relating to the Service is limited to the amount you paid for the order the claim relates to. These limits don't apply to our fraud, gross negligence or willful misconduct, or to death or personal injury caused by our negligence.
16. Your responsibility to us
If someone makes a claim against us because of what you entered, or because you used the songs or the Service in a way these Terms don't allow, you agree to cover our reasonable losses and costs, including reasonable legal fees, to the extent the law allows. This doesn't cover anything we suggested or added, or harm caused by our own actions.
17. Resolving disputes
Please read this section carefully. It affects your legal rights.
Talk to us first. Before starting an arbitration or a court case, email support@wonderito.com with your name, your order email, the problem and what you'd like us to do. If you need our legal name and an address for legal papers, email us and we'll provide them. We'll both try in good faith to solve it within 60 days, and any deadline for bringing the claim is paused during that time.
Individual arbitration. If we can't solve it within 60 days, you and we agree that any dispute arising from or relating to these Terms, the Service, your songs or any order (a "Dispute") will be decided by binding individual arbitration, not in court, except as this section allows. The American Arbitration Association ("AAA") runs it under its Consumer Arbitration Rules (adr.org), and its Mass Arbitration Supplementary Rules apply if 25 or more similar demands are filed with the help of the same lawyers or organization. Hearings are by video, phone or written submissions, unless the arbitrator decides an in-person hearing is needed, which will be in the county where you live. Fees follow the AAA's consumer fee schedule. The arbitrator can award only individual relief, and the decision is final. The Federal Arbitration Act governs this agreement.
Small claims. Instead, either of us may bring an individual claim in small claims court in the county where you live or in Wyoming, as long as it qualifies.
No class actions, no jury. You and we will bring claims only as individuals, never in a class, collective, consolidated or representative action, and we both give up the right to a jury trial, to the extent the law allows. If this waiver can't be enforced for a particular claim or remedy, only that claim or remedy goes to court under Section 18, after the arbitration ends.
Exceptions. Either of us may go to court to stop infringement of intellectual property, or for urgent relief against unauthorized use or abuse of the Service.
Opting out. You can opt out of arbitration within 30 days after your first order by emailing support@wonderito.com with the subject line "Arbitration opt-out", your name and the email you used at checkout. Disputes will then go to court under Section 18.
Changes. A material change to this section won't apply to a Dispute that arose before it, and you can reject it by emailing us within 30 days after we tell you about it. If the law where you live lets you bring a claim in your local courts, or doesn't allow consumers to agree to arbitration in advance, this section doesn't take that right away.
18. Governing law and courts
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules, and the Federal Arbitration Act governs Section 17. Any Dispute that isn't arbitrated or taken to small claims court will be decided by the state or federal courts located in Wyoming. This doesn't take away any protection the consumer laws where you live give you, including any right to bring a claim in your local courts.
19. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top, and for a material change we'll also email customers before it takes effect. A change never applies to an order placed before it (unless it gives you more rights) or to a Dispute that arose before it.
20. General terms
These Terms, the Refund Policy and the Privacy Policy are the entire agreement between you and us about the Service.
If any part can't be enforced, the rest still applies. If we don't enforce something straight away, we can still enforce it later.
You can't transfer your rights under these Terms, except by giving songs as gifts. We may transfer these Terms as part of a merger, acquisition or sale of assets.
We aren't responsible for delays or failures caused by things beyond our reasonable control, such as outages at our technology or payment providers, or natural disasters.
We may send notices to the email linked to your order, and they count as "in writing". You can send notices to support@wonderito.com.
